Along with steps one through six in the blog titled:  What to do if you are in an Auto Accident in Canton, Georgia ~ part one.  The seventh step that you should follow in an Auto Accident is not to make any comments.  Do not admit to anything involving the accident.  Keep all your comments and your information to yourself.  This is the time to remain silent.  This is not the time to admit or deny blame.  Let the attorneys handle what you do and do not say later on in your case.  You may feel the need to be very helpful and speak at this moment, but remember to remain silent and not make any comments.

The first step that you must follow in an Auto Accident is to stop your car.  If you do not stop your car, then you could be charged with a hit and run which will only make matters worse in this situation, not to mention possibly leaving injured people without proper help and possibly death.  Therefore, the first step in an Auto Accident is to stop your car.

The second step that you must follow in an Auto Accident is to assist the injured.  Whether the injured is yourself, a passenger in your vehicle, the other driver, or a passenger in the other vehicle, it is very important that you assist the injured.  For example, call the police or an ambulance and be sure to tell them your location and the direction in which your were traveling so that they can find you as soon as possible.

Do not render aid to someone unless you are qualified to do so.  Do not move an injured person but you may cover the person with warmth such as blankets or jackets.  If an injured person is bleeding and you are qualified to render first aid, then you may be able to stop the bleeding by applying pressure or a tourniquet.  If a person is unconscious, then do not give that person anything by mouth.  You can also render assistance to injured person by following the next step.

5-hour-energy-death1It has been recently shown that energy drinks such as Rockstar, Monster and RedBull (my personal favorite) as well as energy supplements such as 5-Hour Energy, which are notorious for keeping people awake, may actually be hazardous to your health.  These products contain up to and exceeding 500 milligrams of caffeine, which is approximately seven (7) times the amount you would find in a Coke or Pepsi.  These are popular products sold here in Canton, GA.

These products are popular with many folks not just since they taste good but because they can keep us awake when we have deadlines such as driving a truck for a living, getting ready for an exam, and partiers who want to club-hop until dawn.  Even to the point where we have seen the rise in the ever most popular mixture of these drinks with alcohol in clubs, bars, and restaurants.

It is important to note, however, that a recent report by the Food and Drug Administration (i.e. the FDA) has suggested that the buzz associated with drinking these popular products could come a severe health cost.  According to the FDA, the use of Monster, for example, and 5-Hour Energy may be connected to 166 health incidents, including 18 deaths, since 2004.  We are talking about deaths, not just nausea, nervousness, lack of sleep, lack of performance after the caffeine wheres off, but death!

A majority of these incidents involved increased heart rates, which we all know can be a catalyst for disaster in many folks, headaches, changes in blood press, nausea as mentioned before, and dizziness.  More than half of these incidents reported were considered serious or life-threatening, requiring emergency hospitalization, and, as mentioned earlier, death.  As a result, the FDA is investigating whether energy products pose a threat to teenagers as well as people with preexisting medical conditions such as high cholesterol, high blood pressure, migraine headaches, hyperactivity, and the like.

Nursing Home Can be Sued in Spite of Contract Provisions GA; Don’t sign away your legal rights!

Senior couple meeting with agentMany nursing homes go out of their way to protect themselves legally in the admission contracts they make with their residents.  These contracts often state that if the nursing home does something wrong that the resident and their family will be limited in their right to compensation.  Residents who sign these agreements usually assume they have no other choice.  Sometimes, however, families can be compensated in spite of what the contract says.

For example, many of these contracts contain Arbitration Clauses.  The Arbitration Clause may say that if there is a legal dispute, that the family can not sue in a court of law and must instead go through the process of Arbitration to resolve the dispute.  The process of Arbitration is explained in greater detail in my website.

Arbitration can be either binding or non-binding.  Binding Arbitration means that whatever decision is rendered during the Arbitration process can not be appealed to a court of law and is binding on the parties.  Non-binding Arbitration, on the other hand, means that the parties go through the process of Arbitration, but that either party may appeal the Arbitration decision to a court of law.
